Dear all,

I have one query regarding the TDS on rent. If we make payment through cheque to landlord of utility bills other than rent. In that case whether this amount paid included in the limit of Rs.1,80,000/- for TDS or else only amount paid as rent to landlord will be considered for TDS .Please solve query.

dear mr. jitendra ,

for thresh hold limit of Rs.180000, only the amount paid for rent will be considered and nothing else . for payments made to landlord for varoius utility services such as maintainence charges etc , tds is to be deducted u/s 194 c

only rent quotient to be seen for threshold limit of Rs 180000 provided that the payment for utilities is against the bills raised by the landlord seperately.

TDS will be deductible only on Rent portion.

If any other utility charges are also being paid then it must be separately mentioned in the Bill or a separate bill should be raised for that.

Also you can refer the rent agreement, if the other utility charges are part of Rent then in such case TDS to be deducted on both.
