Dear Sir,

This is regarding the Tax on the PF Withdrawal.

I have a 4 Years and 9 Months old PF account (Active for the period). I am a member since Sept 2009, my service came to an end on Jun 2014 (4Yrs 8Mnts) and now the account is inoperative for past one year (Since Jun 2014). After adding this one year, my account is there for 5 Years and 8 Months. I want to know whether it attracts tax, if I withdraw my PF Account.

If it attracts tax. where do I need to mention the PAN number in the Form 19 in order to deduct Tax at Source @ 10%. Is there any provision in the form (though I did not find it)? or Just keeping a copy of PAN Card photostat is enough.

Please clarify my doubt.

Hi,

5 years is the period of continous employment but not the tenure of PF Account.

In your case it is just short of 5 employment years.   Hence if you withdraw now, it would attract tds per new regulations.

Firstly, YES! TDS will be applicable on withdrawal from PF as the words of 192A state that "period of service" should be 5 yeras or more.

You will have to submit a copy of PAN along with the withdrawal application form so that TDS @ 10% is only deducted.

Would like to ask why the service was terminated. If not covered under 8(ii) then above replies already explained the answer

 

8. The accumulated balance due and becoming payable to an employee participating in a recognised provident fund shall be excluded from the computation of his total income—

 (i)  if he has rendered continuous service with his employer for a period of five years or more, or

(ii)  if, though he has not rendered such continuous service, the service has been terminated by reason of the employee's ill-health, or by the contraction or discontinuance of the employer's business or other cause beyond the control of the employee, or

(iii) if, on the cessation of his employment, the employee obtains employment with any other employer, to the extent the accumulated balance due and becoming payable to him is transferred to his individual account in any recognised provident fund maintained by such other employer.

Dear All, i worked in company for 3 years and resigned due to non payment of salaries for 4 months. Now I have completed 5 years from the date of joining. At present, I have completed 59 years . If I withdraw the pf contribution,is it still taxable ? pl clarify

Yes, since you have not completed 5 years of continuous service.

I also would advise to mention your PAN on face of the form 19 to avoid any mess up at other end.!
You should fill 15 g so that no deduction will be there you will get full amount
You need to be in continuous service of 5 years
If you are not a incometax payee you can submit. Form 15g , for not deducting tds
Whether the TDS provision apply to PPF ?
If your service below 5year you should deposit your pan cards copy alongwith form 15G no TDs deducted
