Tds on foreign payments

Our client is a pvt ltd company,in India,providing translation services.It has to make payment to its Malaysian counterpart,which has provided translation services to our client.The Malaysian company does not have any permanent establishment in India.India and Malaysia have DTAA agreement.

My query is whether our client deduct tds on such paymemt?

Hi can you please tell me as what you have done in this case. as being a proprietorship do we need to deduct tds while making a payment for translation services to a freelancer individual. hoping for a early reply and thanks in advance
