TDS on 115BB

I have been playing in the dream11 app.

I had winnings of 246170 rs in the months of april and may 2023.While withdrawing the amount,tds of 73000 rs was charged.

In the next 10 months from june 2023 to march 2024,I had huge losses that the overall net loss is over 3 lakhs.

So,In the financial year 2023-2024,I had lost more than 3 lakhs and I have also paid 73000 rs as tds.

Is this tds refundable?

Logically it seems like I should get this refund.

If it can be refunded,what should I do?

No. Refund is not possivle. You need to file relevant ITR.

Firstly the provisions are of section 115BBJ for online gaming and taxability is on net winnings so if u incur losses for that it can be set off as the act is silent unlike in offline windfall winnings

Agreed for applicability of tax over net winning.

tds has been incurred in section 115BB instead of 115BBJ.

Should I request to change this or both the sections are same?
