Hello, I have a rental property that is rented out for over Rs. 50,000 per month. My tenant deducted money for TDS for year FY19-20, but has not deposited it into my TDS account. He keeps saying that he is in touch with his accountant and will do it shortly. As a result, I have not filed taxes yet, waiting for the money to be deposited.
If the TDS does not show up in my 26AS form by 31-Dec, what recourse do I have? Can I go ahead and file my taxes and ask him to deposit the TDS for FY2020-21?
Thanks in advance for your help!

Quick Summary
A landlord is seeking advice because their tenant deducted TDS on rent exceeding Rs. 50,000 per month but has failed to deposit it. The landlord is concerned about filing their income tax return and potential penalties if the TDS doesn't appear on their Form 26AS by December 31st. Advice suggests filing the return on time, pursuing the tenant for deposit, and potentially revising the return if needed, especially if rent transactions are documented.
You should file your Ir return in due time and ask your tenant to deposit the tds asap otherwise you will not get any refund. otherwise if tds is not deposited in due time then it will attract penalty of 200 rupees per day u/s 234E
You file your return now , then ask the tenant about the consequences of non - filing , then after tds filing , verify the tds is credited to your PAN , then revise your IT return before 31st Marc 2021
& do not verify ur orginal return ( ie , 1st return filed by you)
