How to file income tax return of a salaried person in case of a person whose TDS has been deducted by the company but TDS return has not been filed by the company..
therefore the TDS is not reflected in form 26as..

can such person take credit of income tax on basis of TDS reflected in form 16 part B

No, you can't take credit on basis of Form 16 - Part B.

You need to request to employer for file TDS return, if your employer not filed return, paid self assessment tax & file ITR and try to recover TDS amount from employer
file ITR mentioning employer's TAN and claim TDS. TDS mismatch can be rectified later
unless and until the said credit is not reflecting in form 26AS, dept will not give you the same.

so better ask your employer to revise their yds return.
if the demand is below 25000/- rectification can be made on submission of original form 16 and up to 1 lakh form 16 plus indemnity Bond
