TDS borne by employer

As an employer, my friend is required to make an ex-gratia payment to an resigning employee..

The employee s compelling the employer to bear whatever TDS amount arrives. And the employer has acquisced to the request..

I would like to know is there any separate manner laid down in the act for such calculation and if so the responsibility of the employer

There is no any such provision for deduction of TDS, employer should consider only that salary which is worked at his company and company should calculate tds as per slab rate and employer is liable to only his own.
