tax refund problem

hello folks

today i went to income tax office seeking refund for the A.Y. 2008-09 for individual return.

the problem is that in the acknowledgement page i.e. the first page chapter VI A deduction has been omitted to be mentioned, although the refund amount is correctly written.Also in the subsequent pages the deduction is correctly mentioned .

today i happened to meet a lady IRS officer in her early 30's.i had a heated argument with her.she was telling me that i cannot claim refund since the time limit for revised return has expired.

this case was being handled by another person in the office before.he told me that they had asked for an application for rectification and no revised return

pls advise is there any possibility

The acknowledgemet belongs to us and by the way u told the deduction particulars were correctly written in all other columns, so the assessment order shud have taken into account the deduction particulars no matter if it was omiited in the ack....


Also, u cannot file revised return as it is time barred, instead any such omissions or arithmetical inaccuracies shall be corrected in the assessement if the supporting evidences are brought by you....

but in ur case as u say that deduction particulars r rytten in the inside of the form correctly, ther shud not be any of a problem....


Even if u lose it to the IRS, its a simple case, practical way of approach will solve this issues easily...


Any better suggestions from frndz??? i too have to confirm this...

An Ack... is not a return. The return in its full meaning a Form 1,2,3 etc., if you fill the particulars correctly then you are eligible for refunds. No matter what the ack.. contains. So, send a letter to the Commissioner of your jurisdiction and seek the remedy
