Summon regarding bogus party

Received a summon from GST department regarding verification of third party/supplier. they are saying I had purchased goods from the bogus party and I have to pay ITC claimed by me on the purchase from the bogus party.

In hearings, I told the officer what are the parameters issued by the govt for finding the bogus party. You have issued the GSTIN to that party and My 2A is showing my purchase details and I had made payment through the bank. so how I responsible for the fraud made by that person.

So now the officer is saying you have to pay the GST through DRC03 otherwise we will block your ITC.

Quick Summary
If you've received a GST summon regarding purchases from a 'bogus party', don't panic. The department claims you owe ITC on these transactions. However, if you have valid invoices, bank payments, and proof of receiving goods/services, and the supplier was GST-registered, you may not be liable. Respond with all documentation and challenge the demand for payment, especially if no formal demand order has been issued.

Why would u pay tax if everything is as per law.

Have you received the goods and services.

U must appeal these matter unless you have intently transacted to party knowing it is bogus party

Yes I have received the goods and one thing I mentioned to forget that department is saying to pay voluntarily and not issuing demand order from their side

Is it a notice issued by dept.

Is it a notice issued by dept.?

If it is a notice.

Respond to it by sharing gstr-2a , Invoice, E-way bill.

If it's just intimation ignore it.

Yes we have shown the 2a, invoices and bank transaction.

Great!!! then let the dept come with legal Justification for payment of such ITC.
