we have hire advocate for legal matter and paid Rs. 5000 for his service but he is unable to provide bill.so can we adjust Rs 5000 with capital account. please suggest

You can make voucher for legal expenses, and show it's as legal expenses in your books of account. There is a RCM applicable on legal services. So, you are also required to Pay GST @ 18% under Reverse charge machanism.
