Please help me. One of my friend is providing civil contractor services for last 10 years having Gross receipts of Rs.95 lakhs in last financial year but had not taken service tax number yet. Now he wants to tkae a service tax number, What is the procedure ? One of the Ca informed me that if you go for Service Tax Registration now, they will know through your Pan Card that TDS has been deducted for 95Lakhs in last financial year & they wiil impose Service Tax, Interest & Penalty.So. What to do now ?Whjat is the way to take Service TAx Number without paying Service TAx on last services provided because he is ready to pay tax regularly onwards.

IF you pay the tax and interest then you need not pay penalty .Even if they find otherwise u will be paying along with penalty.Better pay tax along with interest .
no that CA is wrong you have only 9.5 lakh gross receipts it did not crossed 10 lakh service tax is applicable for those persons whose gross receipts exceeds 10 lakhs but registration is necessary when your receipts crossed 9 lakhs it is better to take service tax registration now , as you did not collected any amount as service tax from service receivers you are not liable for service tax, but registration is necessary
