I have paid service tax on mandap keeping for last year. Later I realized that under mandap keeping, immovable property rented out for film/TV shooting is exempt. Now, can I claim refund of service tax paid as the services provided is exempt from service tax. I have also been filing service tax return regularly.

If you pay service tax erroneously, you can claim set off of the same against tax liability of next quarter provided you are providing taxable services [Rule 6(4B)] by following the prescribed procedure. Alternatively, you can seek refund of the same by making an application for refund to the jurisdictional supdt.
