Quick Summary
This discussion addresses a query about a service tax payment notice received for the 2014-15 period. The main concern is how many years back the GST department can request income tax records, with a particular focus on the 2014-15 period. The conversation clarifies that while the general limit is 5 years, extensions due to COVID-19 and specific grounds like fraud can impact this. It also touches upon the calculation of service tax liability concerning turnover thresholds.
Okay, and the computation of service tax liability will be over and above Rs. 10 lakhs right? for example, the ITR shows 16 lakhs, so the service tax liability will be on Rs 6 lakhs? because it is over and above 10 lakhs.. kindly confirm the computation basis
ST department can issue notice to verify for the period not more than 30 months from the date of notice. They can go beyond 30 months until 5 years only if they they have the grounds of fraud and willful misstatement or suppression of facts.
Section 73 deals with this.
