Dear Members,
I need clarification as to whether VAT or Service Tax or both will be applicable on Lease / Sub Lease of Immovable property in the following cases: -
1).Operating Lease of Immovable Property
2).Financial Lease of Immovable Property.
If possible plz provide some reference.

Under any VAT laws in India leasing of immovable property is not taxable.

But Service Tax should be charged on leasing of property be it Operating or Financial lease.
