Service tax on labour contractor

Sir,

we are providing labour as labour contractor to client not for security purpose. under the categery security services it was excluded and also excluded form man power recrutment agencies categery. we have provided this services for the period march 2006 onward without charging service tax . can any body help me out whether it was correct or we have to pay even though not received from clients

Service tax is applicable as business auxilliary service.

What makes you to think that the service is not covered under manpower supply service?

 

Dear Mr.Nitesh,

Services provided by you are comes under service tax as Manpower supply services, and payee is required to deduct tax at source under sec 194C as these are contract services for him.

you was there for required to Charge sevice tax in bills if your services

are above the minimum exemption limit of service.

The labour contractor should obtain service tax registration, raise invoice indicating value of service rendered and charge service tax.  After receiving the amount from company the same should be paid to the Government.

Sirs Casual labour contractor is charging on his bills for Reimbursement of Labour cost + His commision and service tax there on.

 

He is also providing us separate bill for the reimbursement of PF & ESI of casual labour and charging his commission on ths Reimbursemt and charging also service tax there on.

 

Can we deduct this commission and service tax on these bills of reimbursemet of PF & ESI as there is no contract for commission and svc tax there on for this reimbursement. Only for PF & ESI we have.

What is the percentage to be charged on Labour contract bill ?  Some says it is 4% (Works contract) and some says it 6% but the contractor charges 12.36%.  Please help me to sort out this and how much is the service tax ?

We are giving labour contract in factory, the worker consists of stitchers & helpers.  Please tell me what is the percentage of Service tax the contractor has to charge on us.
     

the manpower supply ( supply of labour) where the responsibility ends with provding the personnel is liable under manpower services. Since you started in 2006 the exemption of 8 lakhs can be claimed for the first bit. Amounts over and above that in 2006-07 would be liable if 8 lakhs exceeded. The subsequent year 2007-08 no exemption would be available as in the previous year the value of taxable servcies exceeded the exemption.

we are pvt ltd company ,an ITES, situated in pune. Our housekeeping contractor and secuirty contractor charges us 12.33% on gross wages as service tax, is it ok?

They are charging correctly.
