Service tax liability on maintenance

please give your advice on the matter of service tax liability on the person who collects a lump sum non refundable deposit (for e.g. Rs. 100/- per sq. feet) for 10 years or life time as a maintenance charges of residential houses of a colony from plot holders (customers).

Before introduction of Negative list it could be fitted under Repair & Maintenance category and after Introduction of Negative list, as it is an activity which is not specifically excluded by way of Mega exemption Notification or included in Negative list of services as per 25/2012 ST and Section 66D of Finance Act 1994 the same is liable for service tax.
