service tax applicable on sub contractor if main contractor is under obligation of service tax ??? i.e. if x is main contractor for building commercial complex rs. 50,00,000 n give sub contract to mr. y of Rs. 25,00,000 then Mr.y is liable to charge service tax to mr.x &  mr.x can get credit of it??

In this case Mr. Y is liable to pay S.T and Mr. X can take cenvat credit of the S.T charged by y.

Dear Friends,

My query is, i am doing sub contract on behalf of a vendor who is doing contract for Railways. As per service tax rule contract for railways, Bridge, dam etc is exempted. In other words the contract for railways, bridge, dam, trunk etc is not to be treated as works contract. My opinion is since i am billing to my vendor i can treat the same transaction as works contract. Am i right ? Kindly reply
