Service Tax

Dear Sir,

An indian company receiving commission on services provided to an foreign company, whether service tax is applicable.  The transaction is the indian company takes orders in india for mangoes which has to be supplied in U.S.A.  The U.S.A company has appointed the indian company as its sales representative to take orders in india and remmit the whole amount collected in india to U.S.A Company for which the indian Company is entitled to commission on such services rendered.  The U.S.A company imports mangoes from india from Navi Mumbai and supplies mangoes to U.S.A for the orders taken by indian company.  I want to know the service tax implications on the above transaction.

Please clarify,

Who gives the orders to Indian Company?

reexplain the money transaction involved, from the Indian Co getting the amount. ?

 

These aspects are important to be known, but prima facie it appears to be a case of Export of Services".
