Service tax

Dear Members,

One of my client is a dealer of leading motorcycle company. In his premises, he is providing some space to Finance Company's agents. When customer opt for this finance company for finance, Finance Company gives commission to dealer in lieu of space provided.

Whether dealer is required to charge Service Tax for providing space and if yes, in which service he would be covered?

Don’t worry too much about the classification, as classification is not mandatory by notification but by Circular, which is not binding on assesses; Further, such classification is merely for the purpose of tracing revenue from different industries; as all the taxable service categories have been deleted with the omission of Sec.65 of the Act.;

However, you may classify it to be renting of immovable property.
