Service tax

Hi Everyone.

I just want to know that if we are providing post sale services to our clients through any other agency. So can we take the credit of service tax or not???? & another thing is that is service tax credit is taken on premise basis or on bill basis as that  bill is raised by that party in our name but they are providing service to another company. How is that possible if it is based on premise?

Dear Anupam

1) Whether the service mentioned by you falls under the definition of Input Service as per Rule 2(l) of Cenvat Credit Rules, 2004?

2) Whether the same falls under the any of the exclusions as prescribed under the Input Service definition?

If answers to the Question 1 & 2 is Yes and No respectively, you can take the credit.
