If a pvt ltd co. Gives a proprietorship concern materials for production nd recieves bill of labour charges. Will the company be liable to pay service tax and under vch head.?

Service tax on works contract under RCM
100 % RCM..??
Actually, for manpower supply its 100%, but for works contract its 50:50.
what if the service provider is not liable to pay service tax.?
Even then the Service Receiver has to pay ST under RCM.
