Seller did not file his gstr 1 can I file my gstr 1

I purchased goods from Delhi , seller did not file his gstr 1 return if I
file my gstr 1 how can I get input tax.

U can claim ITC via 3b and not by GSTR 1

Ur supplier needs to show it in his gstr1 return  then only u can avail the same.in gstr-3b.
