As per sub section (3) of Sec 272 of the Companies Act,2013,

The Registrar shall be entitled to present a petition for winding up u/s 271,except on grounds specified in clause (a) or (e) of 'that sub section'.

Of which Section is 'that sub section'?

it refers to section 271(1) (a) &(b)
(a) states company suo moto wind up by spl resolution.
(b) tribunal winds up on just and equital ground.

in both cases registrar can't make application because it's specific right given to the company and tribunal.

a small correction in the above.. replace sec271(1)(e) instead of 271(1)(b)
