as per Finance Act 2015 TDS is also required in case of Transporter if he gives declaration. Now is there any clarification that if a transporter is owning less than 10 vehicle and also gives declaration but he is providing services on commission basis from other transporters. whether there is any liability of TDS

Dear Sourabh,

Generally most of  transporter does transport business on commission from other transporter as you said.

Now coming on your question, if transporter owing 10 or less than 10 trucks and he gives declaration, than no need to deduct TDS, except he raise exclusive commission invoice.

Thanks for the reply sir.. But as I think the very purpose of section is that TDS should not be deducted on small transporters. Whether from this the very purpose of section will not be defeated?

This is government rules, be practical who owing more than 10 vehicles, how can be small transnporter...

If his income does not cross threshold limit, than he can claim in his IT return.
