Restriction of new purchase factory

I have doubt about new purchase company is there any restriction for new purchase company if company is opp (means road opp) to our cuurent company as well as if company is in our side but it is 2 time next to our cuurent company.

I asked this because currently we purchase new machinery for this company but on credit of capital goods we can take cuurent company or what we do?

Mr. Adsul,

Pl see the section 2(e) of Central Excise Act.

So far as I understood it will be trated as separate Factory as it is not situated in the same premises or precinets thereof. Thus a plant far away from another plant of the same manufacturer. It can not be treated as part of a composite factory. Diamond Cement V. CCE -1994(71) ELT 514 (CEGAT-3 member bench order).
