a company is formed with two members and they are also directors of company. the name is striked off by roc
and also now there is dispute between two members .
the company is striked of for non filing of annual returns and financial statements for 2 years or more
as of now one of the member is ready is to file all the defaulted returns and pay penalty.
but the other member is not cooperating to do so .

As per section 252(3) any member, creditor, workman can apply for restoration of the company. So, even a single member can file for restoration of the company.
File a petition in NCLT in form NCLT-9.
Along with this, you can also file a petition for oppression and mismanagement against the other member. So that the other member is bound to present all the documents which are required for restoration.
