Hi

The business is to provide repairs to the computers and if some part is bad, replace that with new part and give it to the customer. And the old part will be repaired in house and again will be given to some other customer.

This attracts service tax but does this attract Excise Duty as there is some 'assembly of movable goods'?

SIR,

    Excise duty levied on production or manufacture of goods it is not manufacture or prodction

Excise duty is on manufacture, which means bringing into existence a new and identifiable commodity. A computer remains a computer even after repair or reconditioning. Thus the activity os repair doesnot amount to manufacture and hence Excise duty is not attracted.
