our total rent including service tax 280000
we deduct tds on full amount this is wrong or true?
bcz we reimburse this expense our another office they said that tds only deduct 250000 on rent not service tax amount
how can clear it

As per circular no 4/2008 dated 28.3.2008, TDS shall be deducted on the rent amount excluding the service tax component. Since you have already deducted TDS on service tax, the excess TDS amount can be adjusted against the subsequent months' rental payments.

as per cbdt circulation For Rent Tds deductiable on Rent amount only , means exculding the Service tax amount.
