Remedies available to service provider-real estate agent

Hi guys,

 We are a pvt. ltd. company limited by share, working as service provider- real estate agent. We have raised the brokerage invoices to our customer- a reputed builder and accordingly the builder has incorporated our invoices in his account and also paid tds to IT Dept. against our invoices as appeared in 26 AS statement. But after following up through so many calls and e-mails he intentionaly seems not to pay to us .

Please suggest us as to remedies available against default made by builder, so that we could proceed to recover our dues from builder.

Send the builder a legal notice for recovery of dues for services provided as per the invoice. Legal notice cannot be ignored by law. One has to reply. Wait for the reply. 

I think this a lenghty process as a civil matter.

Can anybody  suggest me any fastest mode to solve it, please..

It will depend on the terms and condition of the contract/invoice. Arbitration clauses are sometimes incorporated in the contract in case there are any dispute in which case a retired judge is called upon to discuss the matter with an unbiased standpoint and settle the issue amicably.  

Sending in a legal notice does not necessarily mean that the matter will go to the civil court. Most of the time, the issue is settled before that. 

And there are associations for particular kind of profession who looks after the members in times of distress. I am sure there would an association only for real estate service providers, who would sympathetically listen to your matter and come up with a solution.
