Regarding claiming exemption under section 80d

Consider the following situation regarding claiming exemption under section 80D of IT Act. A mediclaim policy has been taken by the Husband for self, wife and child. But the husband is not an income tax assessee. So the wife being an income tax assessee wants to claim that exemption.

Whether the wife can calim exemption under Section 80D? If yes, in which rules does the IT Department mentions this.

To Claim exemption under section 80D the payment should be through cheque. For whose account the cheque has been paid they can claim the exemption under section 80D.

Can not claim in above case as husbund has taken and paid. if wife has paid than only she will be able to take.

she can not claim deduction u/s 80D as she had not paid by her own

 

Thank you for the reply. What about section 80C exemption, where the proposer of the policy is husband whether wife can claim exemption based on the premium paid?

Yes, She can Claim because an individual can take policy on his/her name,spouse and their childrens.

yes the wife can take exemption u/s 80C as policy can be taken  in the name of spouse. as well

 

Payment of mediclaim by the assessee is necessary to avail the benefit of sec 80D.

 

Since the payment of mediclaim policy is made by husband, wife can not take the deduction u/s 80D of IT Act. 

whether can husband  claim the 80D exemption for the policy in the name of wife (she is not a Income tax assesse) who paid the premium amount from joint account but the source for that is husband's pension? 

Mr.MA.P.Kartthikeyan  Yes, Husband can claim 80D exemption for the policy in the name of his spouse,childrens and parents if the payment made by him.  In your case payment making by the Husband(i.e from his source of income) so he can claim exemption u/s 80D for the policy in the name of his wife.
