Rectification of name of a company

Hello,

The corporate name of a company is similar to a registered trademark. Can owner of the registered trademark file an application with Regional Director / ROC for rectification of name of that company under Section 16(1)(b) of Companies Act, 2013 ? Does the RD / ROC direct that company to change its name ? Information on any such precedents would be welcome.

Hi,

 

if the trademark owner feels that the name is similar, then there is no harm in making an application with the CG for name change.

However, whether or not the company will be directed for name change entirely depends on the CG's opinion.
