Received form 16a - use itr-4s or itr-4 ?

Hi Experts,

I worked as a freelance sales consultant for a firm and received 3 Form 16A with TDS details for the 3 quarters I worked. So, my queries are:

  1. Can I can use ITR-4S to file my income tax and claim the TDS as the refund amount?
  2. If I can do the above (using ITR-4S), do I need to submit any supporting documents to claim the refund?

I would greatly appreciate your expert opinion in this matter.

Thanks,

Amit

Since u r providing consultancy services, income is regarded as professional income, in which case ITR4S is not applicable. U need to file ITR4. Sum total of TDS deducted can be claimed as refund, if no tax or less tax is payable on the income.

Hoping that ur income/receipts does not exceed Rs.25 lacs, u don't have to submit any document along with ITR. Just fill up the form, general XML file and upload the same in IT website. If possible u can contact a tax consultant for the same too.
