Recd notice from cpc for ay 16-17 treating return as invalid

Hii Friends,

Return for the Assessment Year 2016-17 was filed on 28/10/2017. On 31.12.2017, CPC issued notice u/s. 139 (9) for correction of certain defects. My client didn't send the written/physical communication which they may have recd from CPC apart from E-mail.

Again, on 17.01.2018, CPC issued another reminder for this matter. Again, my client didn't send the written communication which they may have recd from CPC apart from E-mail.

Now, yesterday, CPC has issued third notice in which they have said that your return for the Asst Yr 2016-17 is hereby treated as invalid.

I have nothing to hide. As turnover of Assessee for that particular period was NIL, we have entered only figures which were available with us. Other than this income, Assessee is also having income from a Partnership Firm which has been offered as such.

Now, what to do ?

The return is invalidated by CPC, it means 'as if not filed'.

After the system gets updated,......... (may be after 10/15 days) you will be allowed to file belated return again (but before March 31st, 2018)..... So take chance to re-submit ITR with all the defects removed.

Or you may get a pleasent surprise email like below

Dear Pxxxx Kxxx,

Please refer the Order u/s. 139(9) issued vide communication reference no. CPC/1617/G5/******* dated 09-JUL-2017 declaring the return as invalid. The matter has since been re-examined and it is decided to consider the return as a valid return.

Hence the earlier Order declaring the return as invalid is hereby withdrawn.
