Quick Summary
This discussion addresses a common issue for trainees: being denied a transfer during their first year of articleship. While the principal's consent is usually required, the advice given suggests that termination of articles in the first year is not strictly controlled by the principal. The user is encouraged to proceed with Form 109 and seek a signature, with the option to escalate to ICAI if the principal remains uncooperative. The difficulty is compounded by the principal's influential past roles within ICAI.
What do you mean, I was saying my principle is strictly saying he will not give transfer, but I am at 1st year of articleship and willing to change my firm and my city, you suggest me what shall I do to so that he get convinced and sign on my form 109
Termination of articles in 1st year cannot be controlled by principle.. u don't need any excuse or reason to get transfer of articles. just put 109 on u r principle table and ask him for signature, if he still bother u , u can complain to ICAI ... in YouTube there is a video regarding this issue uploaded by some CA , check it out for procedure to follow.
