Dear Sir/Madam

1. Is there a cap on immoveable property gifts made to relatives?
If yes then at what rate gift tax is levied?

2. What is the definition of relative?
Does a sister or brother fall under the category of relative under gift tax?

Yes, As per section 53 (2) (vi) gifts in access of 50,000 (in cash) are taxable exept on some occassions and from relatives. Please go through section 53 (2) (vi) for details.

Gifts in kind are not taxable at all.  However for tax implications you will need to see the rules relating to clubbing of income.

Yes, Brother and sister fall in the definition of Relative for the purposes of this section.

Just want to correct waht Naveen said that the Secis 56(2) and with the Finance Act 2009, Gifts in KIND has also been made taxable exceeding Rs. 50,000...

   Provided further that this clause shall not apply to any sum of money or any property received—

      (a) from any relative; or
      (b) on the occasion of the marriage of the individual; or
      (c) under a will or by way of inheritance; or
      (d) in contemplation of death of the payer or donor, as the case may be; or
      (e) from any local authority as defined in the Explanation to clause (20) of section 10; or
       (f) from any fund or foundation or university or other educational institution or hospital or other medical institution or any trust or institution referred to in clause (23C) of section 10; or
      (g) from any trust or institution registered under section 12AA.

Relative means:-

           (i) spouse of the individual;

      (iibrother or sister of the individual;
     (iii) brother or sister of the spouse of the individual;
     (iv) brother or sister of either of the parents of the individual;
      (v) any lineal ascendant or descendant of the individual;
     (vi) any lineal ascendant or descendant of the spouse of the individual;
    (vii) spouse of the person referred to in clauses (ii) to (vi);]

WHO ARE ALL COVERED UNDER THE CATEGORY any lineal ascendant or descendant of the spouse of the individual"? IS MATERNAL UNCLE OF THE SPOUSE OF THE INDIVIDUAL WILL BE TREATED AS A RELATIVE FOR THIS PURPOSE?
