Preference shares

Pursuance to section 55 read rule 9 of the Companies Act, 2013 which doesn't allow to change the class of preference share non-cumulative to cumulative preference share. 

However, section 48 of the Companies Act, 2013 allow such variation subject to fulfilment of the condition as mention thereunder. 

This is based on my understanding of the provisions of the companies Act, 2013.
