THIS IS NOT FOR ME BUT ONE OF MY FRIEND IN 2ND YEAR ARTICLE SHIP

EMPLOYER (WHEN NO ONE IN THE OFFICE) TO MY FRND :- IF YOU NOT GIVE ME SAME THEN I WILL N OT GIVE YOU THE EXAM LEAVE & ALL STUPIED THINGS & EXT..................

You should take help of the ICAI regarding this issue.

And also you can take legal action against the XXXXXXXXXXXXXX employer.

I will try my best to help you out.

Please ask your friend to record the above conversation next time whenever shre feels this type of conversation is going to happen so that there is evidence of the misbehaviour with the friend and then complain about the same in the institue.

And ask ur friend to be bold enough to take that step and do that. Remeber if this type of thing is there and u have evidence the whole CA fraternity (including members & students) will be with you in support of you.

So dont think that the CA is a renowned CA (if at all he is) and nothing can be done of him.

Absolutely agree with Aditya.

But for any compalint, in real world you need evidence. So my first advice to you for your friend is that avoid sitting alone in offce  at late times. Also, in case anybody pressurize you, then discuss this thing with any of your trust worthy colleauge in office to help you in getting eveidences about the principal behaviour and also who can support you while making compalint against him.

Also, write now a formal complaint to ICAi regarding this issue, so that you can have prove that you already complaint in past about the misbehave.

Human being and respect for others is above evrything and evrybody. 

Agree with my friends above.. have some concrete evidence.. may be recording will do...  OR:

1. Get ur all documents regarding the work done in office.. any copy of attendance and alll.. just proof of that she has worked in the office for some years... after that you can write it to ICAI president with cc to WIRC< NIRC etc about the problem. so that the employer wont turn back for the behavior of the girl....

Do not worry he may be anyone... just have some proof... if possible just tell name or city from where he is.....

I agree with Aditya sir. Create evidence against that person. Then go ahead with a complaint of harassment and molestation case. No one is above law.  Don't worry, we all are with you. If you are in Chennai/Tamil Nadu and any help required do ask me without any hesitation.

There are two methods

  Satyagraha method

Giving complaint to ICAI

Correct method

Just slap on face of the concerned person, then only he will learn...

Assuming the Principal is a male and the trainee is female (there are weird people around with weird preferences).....


Someone has to take the initiative.. maybe your friend can escape these situations by avoiding the lone moments, but this pathetic person will still be on the loose, bothering others.


Maybe, trying to take such initiatives she might get into trouble herself. Think before taking your steps (see what kind of person he is - thug type, or just a bully but coward-inside and his contacts - does he know any thugs, bad people, has contacts in police, etc..), but talk with your parents. Of course, recording the conversation secretly is strongly recommended by me too.


Some suggestions from me -


1. She can be diplomatic and somehow manage taking transfer by giving some excuse or strong measure, eg. - record the conversation and threaten him to grant transfer. Usually CAs are pretty cowards. But, he can still bother others, after her.


2. You guys could additionally take photos/ record using pen-cam (sting operation) secretly if possible, later black-mail or, take the case to police.


3. Maybe she can threaten him, by saying if he bothers her like this, she will commit suicide and leave a suicide note blaming him, ruin his life, etc. End it here, everything will be forgetten and forgiven.


4. You and her should talk to your parents along with other trainess of trust (ones not close to the Principal).


5. Talk to his wife (if married), and/ or parents (if around).


6. Talk to a women right organisation/ police in your area.


7. Write to the Chairman/ ICAI, who think a person becomes a GOD after becoming CA (considering the amount of power/ trust they give to CAs in terms of audit/ trainee matters), if you prefer do it anonymously,

 

Most CAs say and threaten trainees by giving such warnings, but things are not that simple as they think.. You too can do a lot harm.. Prefer taking legal steps in order to keep your case strong..

AS everyone has said collect some evidence against him and then reach the higher authorities of ICAI and everyone is here to support u against these kind of mis- behaviour from any towards a female article.

 

Really these kind of people should be given very tough lessons.
