Packing of imported goods for trading

25 kgs bag to 25 kgs bag, does not amount to manufacture, provided the sale invoice have same descripttion.

SIR WE HAVE IMPORTED - SULPHUR BLACK  AND SAME IS MENTIONED ON BAGS @ 25KG

NOW WE SHALL REPACK FOR OUR BUYER IN 25 KG BAG -BUT ON THIERCOMPANY BAG THEY HAVE MENTIONED THIER TRADE NAME + SULPHUR BLACK  ON BAGS

WHEREIN THE INVOCIE AND CHALLAN WILL BE PREPARED SAME AS IMPORT DESCRIPTION + SHOWING THE TRADE NAME OF THE BUYERS IN BRACKETS

IS THIS OKAY ?KINDLY GIVE UR ADVISE SIR

you can not publish the trade name of anybody while repacking, 

you have to make invoice "sulpher black" only

THE BUYER HAS GIVEN US AUTHORITY LETTER TO US ,

TO REPACK IN THIER COMPANY PRINTED BAGS WHICH HAS THIER TRADE NAME ON IT .

KINDLY ADVISE 

if the bags are supplied by buyer, then there is no issue as its not the materials of yours, but you can not issue invoice with their brand name. and no document will carry the new brand ( to save the situation old brand also removed)

SIR WITH REFRENCE TO THE WHOLE ABOVE DISCUSIION I WOULD LIKE TO KNOW -

A) SO WHILE REPACKING THE GOODS IN MY BUYERS BAG DO I COME IN FAULT OR PROBLEM EXCISE DEPARTMNT WISE .

B) WHAT ARE THE PAPER WORK I SHOULD KEEP READY WHILE PACKING MATERIAL SO I CAN PRODUCE THE DOCUMENTS WHEN REQIRED

as the bags are supplied by your buyer, 

you have to keep records of 1) Proforma invoice issued to buyer, and their acceptance ( without any brand) and the clause that you are ready to pack the materials in bags supplied by them. 2) at any place in documents or in physical you dont have to mention the brand name of anybody. 3)as the goods are to be cleared under dealers registration, there is no issue relating to manufacture, hence you dont have to take notice even of the brand or anything printed on the bags which are supplied by the buyer. 5) you have to preserve the challan of buyer for the supply of the bags for repacking ( ask them not to mention any brand name specificaly on challan, it may be sent as "bags printed/ unprinted for repacking of goods")
