NRI Tax exemption

Hi,

 I worked in US for about 166 days on a work permit in finacial year 2009-2010. Since I did not complete the mandatory 183 days for income tax exemption in India, for the earning earned in US, TDS was deducted from me. Is there any option to get back this amount as the financial year has also got over ?

Dear Sir,

From the facts that you have mentioned it appears as if ur Residential Status for the FY 2009-10 is that of a Resident & Ordinarily Resident in India.

And therefore the income earned will be taxable in India..

There are no provisions to get the direct refund in respect of the taxes paid in US but then u can claim Relief u/s 91 in respect of Taxes paid in US...i:e the amopunt that u have paid in US as Taxes will be reduced from ur Tax Liability in India (but maximum amount that will be reduced will be calculated in accordance with Sec 91 i:e Average Rate of Tax)
