Greetings of the day!

 

We are working with defence and supply Iron & Steel (M S Plates) of Chapter 72, the defence department has informed us that under the Notification No. 64 / 1995 - Central Excise dated 16.03.95 we need not charges Excise as they will issue Exempt Certificate under Notification No. 64 / 1995 - Central Excise dated 16.03.95. Our queries is:

 

We are traders and not registered with Excise and we buy excise paid goods so how we will get the refund of the Excise paid if the defence issue us Exempt Certificate under Notification No. 64 / 1995 - Central Excise dated 16.03.95

you have to procure the certificate in name of manufacturer, and procure goods direct from manufacturer against that certificate, there is no way to honour such certificate by a trader.

Notification 64/95 is applicable only for manufacturers and not for Traders. You can follow Mr. Sharma's suggestion but, if there is a possiblity of losing the customer (Defence may buy directly from Mfr), Inform Defence about the non-applicability of the notfication for traders and collect duty or don't collect the duty and bear the cost.
