New notice under 143(1)

ITR 511 views 16 replies

I had received a intimation under 143 1(a) for mistakes I made while filing the return where I forgot to enter "Income from other Sources".The total tax due was 31K for AY 2017-2018.After the intimation I then paid the due tax under "Self Assessment Tax"

Couple of days ago  I again received a new intimation but now under 143(1) with added interest of 490 rupees to the already paid 31K.The due tax now in the new intimation is 31K+490

Please let me know what should I do next ?Should I file for rectification if yes then under what option should I do so ?

You had paid the tax earlier, but may not have replied to the notice, PROPERLY.

Now just pay the additional amount,  under sub-head (400) Tax on Regular Assessment, and file rectification request stating the amount already paid vide challans no xxx dated xxxx ; and request to nullify the outstanding demand.

Good luck...

Thank you for the reply. Is it ok if I just "disagree with the demand"-and enter my BSR code and other payment details for the outstanding tax demand under 143(1) or I have to file for the rectification ?

Yes, you have to disagree the demand first....... with the reasons........ amount already paid vide Challan nos........ But if the demand is not removed by next 15 days, you will have to go for rectification request.

Thanks once again for the reply. One last question..If I have to file for rectification then what option should I select ?

Would it be : "Taxpayer is correcting data for tax credit mismatch"

Or the second option

"Taxpayer is correcting data in rectification"

If it has to be "Taxpayer is correcting data in rectification" then what suboption should I select in that ?

Would that be : "Tax payment has not matched as per CPC order"

Thanks once again. You have been of great help.

"Taxpayer is correcting data for tax credit mismatch"

Thanks once again. But would it mean I will have to make changes to challan from 300 to 400 ?

No need to change old paid challan of 31K, while new challan will be paid under sub-head 400 itself.

Thank you very much.Keeping fingers crossed..

Just an update on the above case... Received a new tax demand notice..The notice has ignored the initial payment of 30 K but it did consider the 561 paid and has asked me to pay the balance amount.
Please let me know what should I do next ?

Are you sure the old paid challan reflects in your 26AS?

If so, again repeat the process with disagreeing te demand.....

Thanks for the response.Yes both the challans are reflected in 26AS.

This is something weird. My rectification has not yet been processed but I have received the new Tax demand on my email. Also I cannot find the new CPC communication reference for the new tax demand on the website. When I enter the reference number it says it is invalid.

What should I do next ? Should I wait for the rectification to be processed.

Yes, assessee cannot file a rectification request, when earlier is pending.

And when the matter has already been specified in earlier rectification request, no need to repeat it, let it be resolved.

So, for new demand.... just disagree with details as rectification request already filed.....

Just as update on the above issue. My rectification was processed and in the rectification intimation that I  received the self assessment tax paid was considered.

So its all good now. Thank your very much to Mr Dhirajlal Rambhia who took troubles to reply to all the queries that I posted.
