Quick Summary
This discussion clarifies the Goods Transport Agency (GTA) GST implications, specifically regarding the 5% rate and Input Tax Credit (ITC). If a GTA service provider opts for the 5% GST rate, they cannot claim ITC. However, if the service receiver pays GST under the 5% Reverse Charge Mechanism (RCM), they are eligible to claim ITC on that supply. Notification No. 20/2017-Central Tax (Rate) is referenced for these provisions.

If GST is paid by the GTA as a service provider then the applicable rates are 5% without ITC or 12% with ITC (notification no. 20/2017-Central Tax(Rate)).

If GST is paid in cash by other person as service receiver at 5% RCM; then he (service receiver) can claim ITC on the same.
We are GTA and we file raise our bill under 5% reverse charge. can we claim ITC or inward supply
No you cannot claim ITC as you are the supplier/provider of GTA service. If you had charged 12% then you could claim ITC.
Could you please share any notification or gst section for the same
I have shared the same in my first reply...notification no. 20/2017-Central Tax(Rate)
Thanks a lot 🙏🙏🙏🙏🙏
