better open a bank account and u pay ur auditor ur stipend for ur period worked in cash and ask him to return it by way of crossed cheque and u deposit it in ur bank to play safe

there are two things are mentioed there.

"paid by cheque" and second is "deposited in account of...."

whenever ca is directly deposting (means transferring into the account of) the only you have write the Account number and name of the bank.

and in th first case i.e in your case u need not to write the account number.

but do not forget to strike off the other option.

becasue i have recived a letter from institute for not striking off and i was asked to resubmit the form.

Amit can u tell me if some one has not taken cheques regularly from his principal, can their be a problem. Institute is not goin to check the bank statments etc of th CA na??

when the instutue will come into picture.

CAs re the members of the institute . so there is hardly any differance between Ca and institute. what i m trying to say. CA do the attest function for the ICAI/Goverment. therefore CAs are trusted person only. so long as there is no problem between CA and artcile both can do anything by joining hands. but if the matter goes to institute, there CA will act as a professional, then article will also have to act in official way.

and for question. so long as there is no dispute between u and ur CA no problem.no problem at all.u r safe

u can write the forms 108,119 etc as way u both decide right and comfortable.

but both should play safe.

do u mean it is not mandatory to open a bank account?

if i just srike off that column is it enough or shall i need to mention  in the form that  i received cash by hand etc..

as per ICAI rule.

stipend should only pe paid by accoyot payee cheque. no cash payment is allowed.

Mr.Amit, I didnot give answer for dummy articleship.If u see in certain firms, the auditors use to pay their articles in cash and at the time of signing their 108/109, they will give a crossed cheque for the minimum stipend prescribed by ICAI and the articled trainees will repay the same in cash.I have seen such firms, so does this means that the articles in that firms are giving dummy..so, there is nothing unofficial in this. so think before u giv some comments

can we open in any bank like icici or only nationalised banks?

any guidelines issued by the institute?

i am not sure.

but i guess there is nothing written about the bank whether only nationalised or other.

but u still check the ICAI regulation or other book for it.

or contact with others.

and waise bhi tumhari articleship to ek do mahino me bhatam ho rahi he na.

tell me one thing, whether does ICAI conducts any checks on scrutiny basis to idetify whether the cheques are coming  into article's accounts or not and take disciplinary action against the CA as well
