According to the Companies Act, 2013, now a single person too can form a Private Limited Company. However not all sections of the Companies Bill have been notified as applicable. So, can a company be incorporated by a single person?? If yes, what is the procedure for the same??

Dear Prerana,

 

yes, for the first time in india, the companies act 2013 has allowed the formation of an OPC.

the procedure for the formation of an OPC is more or less the same as incase of a normal company except that, it will have only one member. however, in the MoA, there has to be named one person, who will become the member incase of the death of the main subscriber to  the MoA. Also, the name of the company should, in brackets mention the words OPC.
