Missed filing Form 107 for excess leaves taken during my articleship

Articleship 700 views 5 replies

Hi, I completed 3 years of my articleship in Feb 2020. As I had 45 days of excess leave, I continued with the same principal until Apr 2020. After completion, I filed Form 108, however, was not aware of the requirement to file Form 107.

During the last 4 years, I had taken a break from the course and now when I tried to register for the Final exam, I was notified that my articleship was not completed.

Please help me understand how to resolve this issue. A couple of alternatives that were suggested to me and the issues I am facing are listed below:

  1. File Form 107 (for 45 days excess leave service) with late fee (Rs. 10,000) and once it is accepted file Form 108 with late fees (Rs. 10,000) [The problem: I did not execute the deed in a stamp paper for the excess service period and now if I execute it, it will be as of current date]
  2. Register under the same or new principal by filing Form 102 + 103, complete the 45 days service and File Form 108 [The problem: I am in employment currently and it will not be possible to resign and register for articleship]

Please let me know if anyone here has guidance on this matter. If I am unable to update the status within next week, my exam registration will be canceled. Thanks in advance.

Hi Harshit did you get any solution ? If yes can you please share it ASAP

Yes, please share the solution as I am planning to go for articleship after attempting around 5 to 6 ACCA exams.

Hi Harshit! Is your query resolved. Please help me as well.

Hi all, I took sabbatical from my full time job and re-registered for the articleship (Form 103). After serving the remaining period under the Principal, I have filed Form 108 and my articleship is completed this month. Hopefully no other issues come up.

That sounds challenging! To resolve this quickly, try reaching out to ICAI directly—they may provide a workaround for filing Form 107 without a current date deed. Another option is to ask your principal for a letter certifying your completed excess leave, which some students have used successfully. If you’re pressed for time, consulting a CA with ICAI experience could help you find the fastest solution. Hope it works out so you can register without delay!
