Mismatch between form 16 & form 26 as

Hi All,

There is a mismatch in my form 16 and 26AS. 

My form 16 shows correct salary and tax liability, however, in  form 26AS my salary shown is less than the actual salary I recieved as per form 16 but the TDS deposited against my PAN in form 26AS is same as my tax liability shown in form 16 which is correct.

So, if I fill my ITR according to form 16, then there will be a missmatch between my income shown in form 26 and filled by me in ITR (which will be higher) although my tax liability will become zero. But if I follow form 26AS as base for my income then i will get refund which in actual is not correct.

So, I am not able to decide on which basis should i fill my ITR- form 16 or form 26AS?

What will be right way to resolve this ? as i have already talked to my emplyer and they are saying that its not possible to correct the form 26AS now. I dont want any tax inquiry from IT dept.

As the ITR filling deadline is approaching please help me reslove this issue asap.

File your return based on your form 16

For now go as per actual data, if its form16 and raise a concern for correction

The employer showed less income or tds. Rectifying the mistake is good for his own sake as well. In my view, it should not take more than 3-4 days in completing the rectification.

 

You could file a return based on form16 and then revised return if needed.
