My father who is dependant on me  and my  reimbursement of medical expenditure by the company is Rs.46,000/-.  Can i claim the  exemption (it is Rs.15,000/- only)  upto Rs40,000/-  as because my father is found to be now having 76% disability in both the ears.

Yes only 15,000 can be claimed as exempt in case of Medical Expenses on Private Treatments..

But there is one more benefit available to u - Deduction u/s 80DD  - amounting to Rs. 50,000/-......

For claimimg the deduction u/s 80DD, u have to file Form 10 IA as a certificate from a Doctor...For details plz refer Rule 11A

Only 15,000 can be claimed as exempt for  Medical Expenses on Private Treatments.....

You can avail the 80 DD deduction - amounting to Rs. 50,000/-flat with less than 80% diability......

For claimimg the deduction u/s 80DD - Medical certificte should be produced...

Thank u and my father  excepting  his hearing problems, otherwise  good.   Whether section 80 DD  with reference to  Rule  11 A after obtaining in Form  10 IA, can i get exemption of RS.50,000/-  even if the medical reimbursement of mine is less than Rs.50,000/-  or only the portion which i spend for him for other ailments also.

If if ur aggregate Medical expenditure in a FY doesnot exceed Rs. 50,000, still u will get deduction of Rs. 50,000....

The fact that u r geeting it reimbursed from ur employer will not effect this deduction...

But make sure that ur Father is not claiming deduction u/s 80U in his own return........

And in the case where your actual expenditure is more than 50k and the disease of your father falls in the enlisted diseases mentioned for section 80DDB then you can claim the whole amount to the extent of rs 60k .in this case also you would have to fill the form 10 i duly certified by the neurologist, urologist or any other specialist working in a government hospital,in this case i have considered your father as a senior citizen otherwise the deduction will be limited to 40k

There is a small twist.  My company is processing my request for a hearing aid for him with a cost of Rs.75000/-  and they are to include this my income.  Further, they are of the opinion that once the hearing aid is given the question of hearing disability does not arise and therefore i cannot claim Rs.50,000/- or Rs.60,000/- as per section 80 U of  iNCOME  tax.   Kindly throw some more light on this my dear friends.

If ur employer reimburse the expenses on hearing aid then undoubtedly if will be taxable as Salary...

Further, as I said that for claimimg deduction u/s 80DD - a certificate from a Doctor in the Form 10-IA is required so if after using this hearing aid, Doctor also feel that now it cannot be said as disability then he will not issue that certificate & hence deduction cannot be claimed...

In short it's neither the employer nor the employee who will decide whether deduction will be available or not, it's the Doctor who will decide..
