If u just wants to file ITR of your wife u need to write to the income tax department, regarding succession certificate, in this case u can file yours wife's return by using your digital signature, as legal hire.

WE HAD HANDLE A SIMILAR CASE LIKE YOURS.

Dear Shikhar,

I.T. Department will give the pernission to file as a legal heir on behalf of a deceased person only on receipt of the following 4 scanned copies :

1) PAN Card copies of deceased person and legal heir

2) Death Certificate

3) Legal Heir Certificate.

While S.Nos. 1 and 2 are not an issue,I am stuck on the Legal Heir Certificate.I am informed by the E-filing cell of the I.T. Department at Bangalore that such a certificate can be obtained from MRO but they are not aware of the location of such an office in Mumbai.If anybody from Mumbai or elsewhere can guide me,I shall be most obliged.Thanks.

I think legal hireship certificate got mandatory recently..............To my best knowlege legal hireship certicate is issue by THEHSELDAR  at our place.
