hi all....... 

i need help or your.

problem is that i will appear in final this May, it will be my first attempt. my articlehip started 15/03/2009, im from PEII,

i am on leave for my exam prepration

i will have leave around 175 days, so whether i am eligilbe to appear in may 11 or not. 

if leave entitlement is calculated on full 3 year basis ie 1095 days then my excess leave will be 

175-(1095-175)/6=21 days, so after considering excess leave im eligilble as my 24 month of articleship will be completed on or before 30th april 2011.

But if leave is calcuclated on for the period i have served, i may not be eligible. the calculation is

175-(777-175)/6=75 days, so after considering excess leave, my 24 month will be completed after 30th april, 

 

plz help u all.......its urgent

hiii sonam dont calculate too much about ur excess leave just negotiate these matters with principal where u registered they can solve your all problem easily its not a big issue . only matter how you deal with your pricipal.

 

As per the regulations of ICAI, a student is required to work for average 5.5 hours a day in the office, but normally all the articles get forced to work for 7-8 hours daily. As per regulations, if the article assistant works for more hours than required in office, then he can claim the set off for the extra hours served. You can easily tell your employer this rule and I am sure if you are regular article assistant, and if you request your employer to write less leave in your submission form, then he will surely agree with you. 

 

i am also agree with Kishor, do some adjustment with your employer and do calculaiton on hourly basis so that there may be less leave days and 24 months might be left before your exam... i think your employer do this favor to you or tell him to give extention if required for adjustments.

problem is, i cant have any adjstment with my charetered as i have serious argument with him, in no case he is going to help me. Even i dont have any  work diary to proov my working hour.I jst wanna knw, Whether, excess leave to be calculated on 1095 days basis or period served upto 30 april 2011.

if calculation to be based on 095 days, than i will appear in exam, otherwise not, even i dont wanna request my chartered for any of my problem.

so please give me detail.........................

As per regulations, calculation of leave shall be as under:

 

Total Period of Articleship 3 years i.e. 1095 Days

 

Actual Leave Taken 175 Days

 

Leave Allowed 1095 - 175 = 920 Days / 6 = 153 Days

 

Excess Leave Taken = 175 Days - 153 Days = 21 Days.

you dont give much importance to the leave calculation at this time ......usually excess leave will be calculated at the time of completion of articleship...but if your boss want u not to write may-2011 exam.....nothing can do....
