KPMG has ruined my life

That notification of the ICAI (dt.27-Mar-09 and dt.18-Apr-09) cannot be applied retrospectively.

If the ICAI is seeking to apply it retrospectively, I suggest you speak to a lawyer & file a writ petition before the appropriate High Court having jurisdiction

I think Shaunak's view is correct, but you need to go to the institute once again and inform the president whateven happened with you...before going to the court.

This will definately help you.

I felt very sorry for an un-professional attitude shown by our profession's leading firm KPMG to you, which have impacted on your career a lot. What I will suggest is to first calm down and think for a while. After reading your case, I found out two issues in it-

1.  Re-registration (subject to announcement dated 27.03.09); and

2. Postp*rnment of your attempt.

As far as your first problem is concerned I will suggest you to talk to KPMG HR that is it possible for them to register you under such of their member who is domiciled in city other than Bangalore. If they do so then that announcement very well favours you, it clearly states that transfers will be allowed on account of change in place of residence. Thus by doing so, on ICAI record you will appear to be registered in any other city.

As far as your Second issue is concerned, then can you please tell me some of your details, so that I can opine you that whether really your attempt is going to be postp*rned or not. Please mail me details like (Date of commencement of articles training, No. of transffers you have taken till date, no. od days leave your previous principal have put on Form No. 109, Your last appeared attempt and proposed attempts) on anshulagrawal @ icai.org

And remember dear, nothing is going to happen by doing stupid things like filin a suit and all that, by doing such act you would be wasting your precious time and money and will be destroying your career. Instead I would suggest you to communicate our BOARD OF STUDIES CHAIRMAN on jnshah @ icai.org or call him on 09822202575. I am also having good approach in ICAI with BOS and President, I'll mail Uttam Sir about your case, but please mail me details before that, and dont worry. Problems are bound to be there. It's cost of your bright future.

Meet the current President. Speak to him personnaly about the wrong doings.Put the complain in writing and get the cacknowledgement of ICAI.Formalise ur complain.

Also if u have any friends who know staff of ICAI, will also help u out. (Mr. Razak.)

Chek from Institute if there is any complain council in ICAI.

Follow Mr. Anshul's Suggestion. In the mean time do not loose ur focus and concentration in studies.

Please go ahead with legal action.

somethings needs to be done at the level of ICAI. MEMBERS  ..... not only a member take unduly advantage of articles...... this discourages a lot of sudents geoing into this profession.... SALUTE TO OUR MEMBERS... WHO JUST SEE THEIR OWN BENEFIT.

Ahhhhh.........Complaints against the CA firms by articles are increasing day by day.......With the begining of PCC or new style of CA course.........this type of complaint are increasing as the age of most of the articles are less i.e. 17-18 years and they cannot work under pressures.......They will start shouting..........We have also same type of pressure at our times but we never complaint about it..........Some of the cases are really very genuine.....So ICAI needs to take some action.

ICAI has habit of regulating students with tougher rules but it never dares to do anything when members fail in their duty. Take the recent DLF case. The news reports that one of sister concern has paid loans worth about 100 crores or more and the auditor failed to report 2(22)(e) dividends. Why  dont the institute take sou motu action against those members? Why it wastes time in creating unproductive rules against students when there are already strict rules??? President Ji please dont play with our lives

In the Regards of Articleship the Members are not at all cooperating the articles but they want that the aritcle should cooperate with them for there work to be completed within the TAT, does not matter if article fall sick or getting in to some trouble  . All Of Us Know( With One Hand No One Can Clap For This TWO HANDS TO BE JOINT) So as this thing , cooperation requiredfrom both the sides.  ICAI should take some serious Steps Regarding This As most of the articles are facing the same problem.

If u have not registered with your native then wait for some time. As already your 6 month is wasted wait some more time and try a firm which will give u back dated article. Search for it , it may take 1 or 2 months but if u can spend that much time then u can save 6 month any how if u register after 2 months also on that date your attempt will not get further pospond by 6 month. its better to take a risk. if u got 102 and 103 signed also do not send to institute and talk to your native to torn his copies also. KPMG is not taking u not because of rules they just doesnt want to take u now. they r just taking hide in new rule. Not to take u looks like it is there commercial decision nothing to relate with institute new rules.

not know wht ur positon,but best option u ve-if 109 not submittee 2 institute,ask ur ca 2 cancel 109,if by chance sumitted,ask ur ca not 2 put it under processing.unless ca institute send letter 2 both parties regarding transfer,109 can be cancelled with mutual consent
